MPS considers legal challenge after former commander’s dismissal is quashed

The Metropolitan Police Service (MPS) is taking legal advice following a decision by the independent Police Appeals Tribunal (PAT) to overturn the dismissal of a former officer.

Commander Julian Bennett was dismissed last year for refusing to take a drugs test. On Friday (July 26) the PAT quashed the dismissal decision and ordered a new hearing.

MPS Assistant Commissioner Matt Twist said: “I am very concerned by this decision and I have no doubt that the public and hardworking colleagues across the Met will be appalled that this case remains unresolved after such a long time.

“It very clearly illustrates why reform of the misconduct process is so needed and why the Met has been calling for urgent change.

“We await the written decision before determining our next steps, but we are actively considering a challenge by way of judicial review. Senior officers are expected to lead by example and Mr Bennett will not return to duty whilst we consider our options.”
