A Greater Manchester Police (GMP) officer has been summonsed to appear in court after being alleged to have assaulted a man in a custody suite.

Sergeant Richard Miller, 45, will face Manchester Magistrates Court on February 8 charged with common assault relating to an incident in Chadderton on July 15, 2012, when he was accused of using excessive force to restrain a 32-year-old man being held on suspicion of assaulting an officer in Oldham.

Sgt Miller is alleged to have dragged the man across the floor of the custody suite while he was already restrained in handcuffs. It transpired later the suspect sustained injuries during the arrest, including a broken arm, but none of the GMP officers who apprehended him will face charges.

The report had been passed to the Independent Police Complaints Commission (IPCC), who said the Crown Prosecution Service (CPS) had decided there was enough evidence to put forward a case against Sgt Miller.
